Surrogacy for Single Women in Mexico
In the landscape of surrogacy, Mexico stands out with its unique legal framework where surrogacy is 100 percent legal (based on case law established by the Supreme Court of Mexico in 2021), which established the having a child is a human right, even through surrogacy, and even for foreigners.
In Mexico, the biological father (intended parent) and the surrogate are listed on the birth certificate (the non-biological intended parent and even in cases where a female intended parent uses her own eggs are not listed on the Mexican birth certificate). This presents a significant barrier for single women seeking surrogacy in Mexico.
For single women, the inability to establish sole legal parentage means they are effectively excluded from pursuing surrogacy within the country’s borders. However, it is common practice for a single woman to use a trusted male friend (or family member if using an egg donor) to be the sperm donor/biological father for a surrogacy journey where he also agrees to be on the surrogacy contract and to complete the exit process for the child (in these cases, the trusted male friend/family member relinquishes all parental rights when returning home with the baby and the single woman becomes the sole legal guardian via an adoption process). So, no need to despair, as long as a known and trusted male friend or family member is available for the process.
